LSGA respects your privacy and we are committed to protecting your personal data. This privacy policy will inform you as to how we collect, share and look after your personal data and to tell you about your privacy rights and how the law protects you.

Important information and who we are

LSGA is a law firm and we specialise in the provision of legal services. All data subjects whose personal data is collected is in line with the requirements of the GDPR.

The data we collect

When engaging with LSGA or its staff during service interactions, some personal information may be collected in order to provide support or advice to individuals as required through our contractual obligations. This information may include:

  • Name;
  • Email address;
  • Telephone number;
  • Address (business and residential);
  • Payment or bank details;
  • Passport or birth certificate, or driving licence information;
  • Tax reference;
  • Profession;
  • Marital status;
  • National Insurance number;
  • Date of birth;
  • Family & next-of-kin details;
  • Medical details or records;
  • Equality and Diversity Data.

The information we collect from you may include sensitive personal information about your race, sex, ethnic origin, sexuality, political opinions, religious beliefs or lack of them, trade union membership, health, criminal offences or proceedings.

The personal data we collect will be used for the following purposes:

  • To provide legal and ancillary services to clients;
  • To administer client matters including but not limited to identifying individuals and to invoicing;
  • To allow the marketing of services, training or events relevant to individuals or businesses;
  • To identify areas where services may be improved;
  • To comply with a legal or regulatory obligations;
  • To assess your suitability for employment with us and process your application;
  • To send you materials that you request such as brochures and data sheets;
  • For analytical purposes including to understand how visitors to our website move around and what content they access in order to tailor content to specific users;
  • To solicit feedback and to support testimonials that you have provided;
  • To enforce security features within our services and to prevent fraud;
  • Where it is necessary for our legitimate interests;

How LSGA collects your data

Personal data will be collected from forms, contracts or correspondence to LSGA by either post, phone, fax, email or through any other agreed communications. This may include data provided when:

  • Requesting or proposing services or fee quotes;
  • Bookings or events;
  • Requesting information and marketing material;
  • Providing feedback; or
  • Applying for a job or work experience at LSGA.

Our legal basis for processing for the personal data

LSGA relies on the following legal bases for the processing of personal data:

  • To provide agreed services;
  • To perform a contract/ contracts, including but not limited to our engagement letter;
  • To comply with a legal or regulatory obligation;
  • Where it is necessary for our legitimate interests;
  • Where express consent has been provided by you.

Consent

By consenting to this privacy policy you are giving us permission to process your personal data specifically for the purposes identified. Consent is required for LSGA to process both types of personal data, but it must be explicitly given. Where we are asking you for sensitive personal data we will always tell you why and how the information will be used. You may withdraw consent at any time by contacting the DPO.

Disclosure of your personal data

Beyond our legal basis and legitimate interests for processing your personal data (see below), LSGA will not pass on your personal data to third parties without first obtaining your consent.

We may pass your personal data to the following parties:

  • partners, employees and consultants of LSGA Solicitors and LSG Services Limited;
  • successors in title to LSGA Solicitors or LSG Services Limited;
  • third party consultants, contractors or other service providers who may access the information who are engaged by LSGA solicitors or LSG Services Limited (including but not limited to, notaries, IT support, translators and document storage services);
  • government bodies, law enforcement agencies, regulatory bodies, financial institutions, legal societies and in response to other legal and regulatory requests from similar third parties; and
  • legal advisers, auditors or contractors or other advisers auditing, assisting with or advising in relation to your matter or the firm.

Any third parties with whom we may share your data are obliged to keep your details securely, and to use them only to fulfil the service they provide to you on our behalf. When they no longer need your data to fulfil this service, they will dispose of the details in line with LSGA’s procedures and/or GDPR.

Retention period

Subject to our regulatory and contractual requirements, LSGA will process and store personal data while you remain a solicitor, employee, consultant, client, supplier or other third party who has entered into communications or contracts with LSGA. It will be kept as long as is necessary to fulfil the purposes for which we collected it, including satisfying any legal, accounting, or reporting requirements in line with the terms of our contracts when it no longer needs to be held.

Any personal data which has been submitted to us as part of our anti-money laundering regulations shall be retained for a minimum of six years in accordance with our terms and conditions of business.

Subject Access Requests

LSGA, at your request, shall confirm what information we hold about you and how it is processed. If LSGA does hold personal data about you, you can request the following information:

  • Identity and the contact details of the person or organisation that has determined how and why to process your data.
  • Contact details of the data protection officer, where applicable.
  • The purpose of the processing as well as the legal basis for processing.
  • If the processing is based on the legitimate interests of LSGA or a third party, information about those interests. ·
  • The categories of personal data collected, stored and processed.
  • Recipient(s) or categories of recipients that the data is/will be disclosed to.
  • If we intend to transfer the personal data to a third country or international organisation, information about how we ensure this is done securely.
  • How long the data will be stored.
  • Details of your rights to correct, erase, restrict or object to such processing.
  • Information about your right to withdraw consent at any time.
  • How to lodge a complaint with the supervisory authority.
  • Whether the provision of personal data is a statutory or contractual requirement, or a requirement necessary to enter into a contract, as well as whether you are obliged to provide the personal data and the possible consequences of failing to provide such data.
  • The source of personal data if it was not collected directly from you.
  • Any details and information of automated decision making, such as profiling, and any meaningful information about the logic involved, as well as the significance and expected consequences of such processing.

Marketing

LSGA may use your personal data to form a view on what we think you may want or need, or what may be of interest to you. You will receive marketing communications from us if you have requested information from us or purchased services from us or if you provided us with your details when registering for an event, webinar or download and, in each case, you have not opted out of receiving that marketing.

Complaints

In the event that you wish to make a complaint about how your personal data is being processed by LSGA (or third parties as described in paragraph 6 above), or how your complaint has been handled, you have the right to lodge a complaint directly with the supervisory authority and the LSGA Privacy Officer.
